A Zaria-based businessman, Ahmed Muhammad Gusau, has filed a criminal complaint against Senator Abdu Kwari, Hajiya Amina Dalhatu Akilu, and Shehu Abdu Kwari, accusing them of fraud and criminal conspiracy over a controversial land and building exchange deal.
The complaint, filed through the law firm Bashir Musa & Associates, alleges that the actions of the defendants constitute offenses under Sections 58 and 306 of the Penal Code Laws of Kaduna State, 2017, punishable under Sections 59 and 307 of the same law.
According to the documents filed in court, the matter began around August 2025, when the complainant, Ahmed Muhammad Gusau, saw a plot of land located at No. 5, Abubakar Mustapha Road, Kabama Layout, Sabon Gari, Zaria, which belonged to Senator Abdu Kwari.
Gusau developed an interest in acquiring the land and reached out to Shehu Abdu Kwari, the Senator’s brother, to help him contact the Senator.
Shehu reportedly told him that the Senator does not sell land but only exchanges one piece of land for another.
Following that, Gusau offered to exchange his residential property at No. 17, Sale Annur Street, Kabama Layout, Sabon Gari, Zaria for the Senator’s plot at Abubakar Mustapha Road.
Both parties agreed that the Senator would take Gusau’s house, which has a Certificate of Occupancy No. 03311-10d51-n2732-10d51-n2337-r943, valued at ₦60 million, while Gusau would take the Senator’s plot, valued at ₦20 million.
Although Gusau’s house was worth more, he agreed to the deal, saying he loved the location and intended to develop it quickly.
After the agreement, Senator Kwari reportedly requested that the Deed of Assignment for the land be written in the name of his wife, Hajiya Amina Dalhatu Akilu, since the title document was already in her name.
The complainant agreed, and his lawyer prepared the documents. The signing was carried out in the presence of the Senator, Shehu Abdu Kwari, Abdurrazaq Abdu Kwari (also known as Babangida), and the ward head, who witnessed the process.
Shortly afterward, Shehu told the complainant that there was an outstanding balance of ₦30 million, but the Senator could not pay at the time because his son was about to get married.
Gusau reportedly responded that he was not concerned about the balance and simply wanted to begin construction, to which the Senator agreed.
Gusau then mobilized his workers and began construction on the land. He purchased all the building blocks from the Senator’s block company, A.A. Kwari Blocks, located along Samaru Road, Zaria.
When the project reached the roofing stage, some KASUPDA officials suddenly arrived and ordered the construction to stop, allegedly saying that they were directed to do so by Senator Abdu Kwari.
By that point, the complainant had reportedly spent over ₦27.6 million on the project, excluding the cost of the land itself. Afterward, the defendants allegedly changed their story, insisting that the land still belonged to them and that the complainant had no right to build on it.
The complainant claims he was defrauded by the defendants, who induced him into constructing on their land and later denied the agreement after he had spent a large amount of money and resources.
According to the legal filing, if proven, the defendants’ actions amount to criminal conspiracy and cheating, offenses contrary to Sections 58 and 306, and punishable under Sections 59 and 307 of the Penal Code Laws of Kaduna State, 2017.
The complainant’s lawyers — Bashir Musa, S.S. Yusuf, and M.A. Babaji — have urged the court to prosecute the defendants and impose appropriate punishment if found guilty.
The court has fixed November 26, 2025, as the date to begin hearing the case.
